Terms and Conditions

These Terms and Conditions shall govern the use of the Alien Smashers mobile application ("Application") made available to you by Porcuplay ("Service Provider") as a Freemium service.
Agreement to Terms
By downloading or utilizing the Application, you agree to these Terms and Conditions. Please read them carefully before using the Application. Unauthorized copying, modification of the Application, or any part of the Application, including our trademarks, is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
Application Use & Modifications
The Service Provider strives to ensure the Application is functional and up-to-date. However, we cannot guarantee this and reserve the right to modify or temporarily remove the Application without prior notice for any reason, including but not limited to:

Adding new features or services;

Removing features or services;

Charging for services that were previously free. We will provide advance notice of any charges where applicable.
In-App Purchases
The Application may include in-app purchase functionality for buying virtual items, in-game enhancements, and other premium features. All purchases are final and non-refundable, except where required by applicable law. When you make a purchase within the Application, you acknowledge that the purchased item has no monetary value and grants rights only to items within the Application.
If a technical failure occurs where a purchase does not take effect but is billed, the Service Provider will endeavor to resolve the issue. However, we are not liable for losses caused by such failures. If you encounter problems with in-app purchases, please email contact@porcuplay.com, and we will assist you.
Data Collection & Privacy
The Application may collect and process personal information to deliver and improve gaming experiences. This may include in-game progress, purchase history, and in-game preferences. You can learn more about how we handle and protect your data by reviewing our Privacy Policy.
Additionally, we utilize third-party services that may collect and process user data. These third parties have their own terms and privacy policies, and we encourage you to review them:
The Service Provider does not control third-party practices and is not liable for their actions or policies. You can request the deletion of your user data and account within the Application by following the deletion options provided in the settings menu, which will permanently remove your data from our servers.
Device Security & Unauthorized Modifications
To ensure optimal performance, please keep your device secure and updated. The Service Provider strongly advises against jailbreaking or rooting your device, as it compromises security features, makes your device vulnerable to malware, and may affect Application functionality. We are not liable for problems resulting from unauthorized device modifications.
Internet Connection & Usage Charges
Certain features of the Application require an active internet connection. The Service Provider is not liable for limited functionality due to lack of connectivity, exhausted data allowances, or service interruptions. When using the Application outside of Wi-Fi, please be aware of potential data charges, including roaming fees, from your mobile provider. If you are not the bill payer for your device, please obtain permission from the account holder before using data for this Application.
Account Suspension & Termination
The Service Provider reserves the right to suspend or terminate your account at any time, with or without cause, for reasons including but not limited to:

Violation of these Terms;

Disrupting other users' experience;

Posing a security threat to the Application.
In the event of account suspension or termination, all in-app purchases and associated items will be forfeited, and no refunds will be issued. While we strive to provide advance warnings, this may not always be possible.
Limitation of Liability
To the fullest extent permitted by applicable law, the Service Provider is not liable for any direct, incidental, consequential, indirect, special, exemplary, or punitive damages, including but not limited to:

Loss of data;

Issues with in-app purchases;

Malfunctioning of devices or software.
Using the Application is at your own risk, and the Service Provider’s liability is limited to the maximum extent allowed by law.
Governing Law
These Terms and Conditions are governed by the laws of Israel. Any disputes arising from these Terms or your use of the Application will be subject to the exclusive jurisdiction of Israeli courts.
User Obligations
By using the Application, you agree not to:

Use the Application for unlawful, harmful, or fraudulent purposes;

Exploit bugs or errors for personal gain;

Use unauthorized tools, bots, or software to interfere with the Application;

Engage in activities that hinder other users or compromise the security of the Application.
Violations of these obligations may result in account suspension or termination, as described above.
Disclaimer of Responsibility for Third-Party Services
The Service Provider integrates third-party services into the Application (e.g., Unity Ads, PlayFab). These services operate independently, and their functionality, availability, and accuracy are outside of our control. We disclaim any liability for:

Issues arising from third-party service interruptions;

Data inaccuracies or privacy violations caused by third-party providers.

Application Updates and Termination
The Application may be updated periodically to improve functionality or address issues. By using the Application, you agree to accept these updates. The Service Provider reserves the right to terminate or restrict access to the Application at any time, without prior notice. Upon termination, your rights under these Terms will cease, and you must uninstall the Application.
Changes to These Terms
These Terms and Conditions may be updated from time to time. We will notify users of material changes through the Application or other available means. Continued use of the Application after changes are made constitutes acceptance of the updated Terms.
